By accessing and using ThumbAwesome, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Service Description

ThumbAwesome is an AI-powered thumbnail generation service that allows users to create professional video thumbnails using artificial intelligence. Our service includes:

• AI-generated thumbnail creation based on text prompts
• Credit-based usage system
• Image download and management features
• User account management
• Payment processing for credit purchases

User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for safeguarding your account credentials
• You must notify us immediately of any unauthorized access
• One account per person or entity
• You must be at least 13 years old to use our service

Credit System & Payments

Credits

• Each thumbnail generation costs 1 credit and produces 4 image variations
• New users receive 10 free credits upon account creation
• Credits do not expire but are non-transferable
• Credits have no monetary value and cannot be refunded to cash

Payments

• All payments are processed securely through Stripe
• Credit packages are non-refundable once purchased
• Prices may change with 30 days notice
• You authorize us to charge your payment method for purchases

Acceptable Use

You agree not to use ThumbAwesome to:

• Generate illegal, harmful, or offensive content
• Violate any intellectual property rights
• Create content that promotes violence, hate speech, or discrimination
• Generate sexually explicit or adult content
• Impersonate others or create misleading content
• Attempt to reverse engineer or exploit our AI systems
• Use automated tools to abuse our service

Intellectual Property

Your Content

You retain ownership of the prompts you provide and the thumbnails you generate. However, you grant us a limited license to process your prompts for service delivery.

Our Service

ThumbAwesome's technology, software, and brand are our intellectual property. You may not copy, modify, or redistribute our service or its components.

Content Licensing

Generated thumbnails are licensed to you for commercial and personal use, including:

• YouTube videos and social media content
• Marketing and promotional materials
• Commercial projects and client work
• Print and digital media

You cannot resell or redistribute the raw images as stock content or claim authorship of the AI-generated artwork.

Service Availability

• We strive for 99% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We reserve the right to suspend service for violations or technical issues
• Credits will not be deducted for failed generations due to service errors

Disclaimers

• AI-generated content may occasionally contain inaccuracies or artifacts
• We do not guarantee specific quality or style outcomes
• The service is provided "as is" without warranties
• We are not liable for how you use generated content

Limitation of Liability

To the maximum extent permitted by law, ThumbAwesome shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of our service.

Account Termination

We may suspend or terminate your account for:

• Violation of these terms
• Fraudulent activity or payment disputes
• Abuse of our service or systems
• Extended inactivity (after 2 years)

You may delete your account at any time. Upon termination, unused credits will be forfeited and your data will be deleted according to our Privacy Policy.

Changes to Terms

We reserve the right to modify these terms at any time. Significant changes will be notified via email or service notification. Continued use after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the jurisdiction where ThumbAwesome operates. Any disputes will be resolved through binding arbitration or in appropriate courts.
